The
New York Times reports, “Honda has agreed to settle a class-action suit that claims the rear brakes in 750,000 late model
Accords and Acura
TSXs are wearing out more than twice as fast as they should.” According to the plaintiffs, a new braking system that debuted on the 2008 Accord and the 2009 TSX can cause brake pads to wear out after just 15,000 miles – long before the 70,000 miles such pads should last.
To date, the National Highway Traffic Safety Administration has received more than 350 owner complaints about the premature brake wear. You can view the complaints through NHTSA's online
database.
Under the terms of the settlement,
Autoblog says, Accord and TSX owners who have had brake pads replaced before 70,000 miles will be eligible to “receive one half of the cost of repairs, or a maximum of $125, whichever is less.” They will also “receive $150 towards the cost of a set of new rear brake pads that Honda says will last longer than the units being replaced.” The amounts don’t sound like much, but if all affected owners make the claim, “Honda could be on the hook for well over $100 million.”
Honda, however, will not have to issue a recall over the brake wear problem, or acknowledge that anything is wrong with the cars. The Times notes, “The proposed settlement says that Honda denies there is a defect or that it has done anything wrong. The settlement also says neither Honda nor the plaintiffs’ lawyers have identified a safety problem.”
